EQUITABLE DISTRIBUTION OF MARITAL PROPERTY AND MARITAL DEBTS


Virginia is an equitable distribution state when it comes to dividing marital property and marital debts. The preparation required to classify, value, and equitably divide marital property and marital debts can be very difficult. We have special expertise in working with experts in preparing for equitable distribution including working with real estate appraisers, appraisers of personal property and furnishings, and experts who perform complex business valuations.


SPOUSAL SUPPORT


Issues involving spousal support include the determination whether a party is entitled to spousal support, if entitled how long, and what the amount of spousal support should be. In using the factors to determine spousal support under Virginia law we have developed relationships with health care providers to analyze the implications of health issues on the ability of parties to work, financial records to determine needs and the ability to pay, and experts in imputing or defending the imputation of income.

The amount of child support is generally determined by statutory guidelines. However, the determination of the income of the parents is very important, and sometimes requires an analysis of financial information that is not easily understood. We have demonstrated the ability to determine income, and when necessary, advocate the factors that allow a deviation from the guidelines.
